Last month, the European Court of Human Rights affirmed its historic ruling that governments have a duty to establish effective mechanisms for ensuring that women have access to abortion where it is legal. In Tysiac v. Poland, the Court held that Poland had violated a woman’s right to respect for her private life by failing to allow her to have access to a therapeutic termination of her pregnancy, although such a procedure was permitted by Polish law. MacArthur grantee the Center for Reproductive Rights, submitted an amicus brief that was referenced in the Court’s decision for its argument that states have obligations to ensure that the guarantee to abortion in their national laws is an effective right in practice.
